    James Nesci


James Nesci is a graduate of the University of Arizona College of Law and was a solo practitioner from January 1st, 1995 to January 1st, 2005 in Tucson, Arizona. He is now a partner in the firm Nesci, St. Louis & West, P.L.L.C. He is an honorably discharged veteran of the U.S. Navy.

In 1999 Mr. Nesci became a Sustaining Member of the National College for DUI Defense. In the Summer of 2001 he was officially Board Certified by the National College for DUI Defense, Inc. and is one of only two Board Certified attorneys in the State of Arizona.

His firm’s practice is devoted entirely to criminal defense. At any one time, he typically defends about thirty DUI cases in several jurisdictions while other members of the firm defend capital murder, rape, armed robbery, possession and varied federal cases. Most recently, he represented former Supremes lead singer Diana Ross on Extreme DUI charges in Tucson and fitness guru Richard Simmons on assault charges in Phoenix.

Mr. Nesci often defends cases well into the .30 blood-alcohol range. Mr. Nesci has caught more than one police officer lying during cross-examination and some police officers have even refused to grant pretrial interviews to him without a prosecutor or their own counsel present. He was one of the lead attorneys on the Intoximeters RBT-IV breath-testing issue in Southern Arizona which resulted in the suppression of breath tests in over 3,000 cases and the removal of the RBT-IV from the streets of Arizona. He is one of only a handful of attorneys in the country who holds a DOT compliant permit to operate an Intoxilyzer® 8000.

In addition to many Arizona Seminars, Mr. Nesci has lectured at several national seminars including the National College for DUI Defense 2001 and 2003 Summer Sessions, the California Attorneys for Criminal Justice Seminar Rules of the Road V, the NACDL DWI Means Defend With Ingenuity© Seminar in Las Vegas, The Nevada State Bar Association Seminar Killer Cross, and the New York State Bar Association's 2nd and 3rd Annual Big Apple DUI Seminars. He has taught seminars on the subjects of cross-examination, trial tactics, field sobriety testing, blood alcohol calculations, opening & closing arguments, ethics, drugged-driving, blood and breath testing. He was a frequent guest of the John C. Scott radio program on KTKT 990 A.M. in Tucson. The Tucson Weekly has named Mr. Nesci "King of the DUI Defense" (December 19, 2002). He has appeared on Inside Edition, Celebrity Justice, Fox News, Access Hollywood and Court TV.

Before the end of the 2005, he is scheduled to teach once again at the DWI Means Defend With Ingenuity© Seminar in Las Vegas, the University of Mississippi's Ol' Miss DUI Seminar in Jackson, Mississippi, the Florida Association of Criminal Defense Lawyers DUI Seminar in Orlando, the California Intox 8000 Seminar in San Diego, and the Intoxilyzer 8000® Operator's Course, in Memphis. Additionally, he is currently scheduled to teach a 2-credit DUI Course at the University of Arizona, James E. Rogers College of Law in the 2006 Spring semester.

Mr. Nesci is married with twin daughters. His interests are traveling, golf, and fast cars. He is an amateur race car driver, mechanic, and a Corvette fanatic.

Being a criminal defense attorney is more than a job to Joseph P. St. Louis. Whether Joe is battling on behalf of someone charged with a DUI, or is squaring off on behalf of a defendant facing the death penalty, Joe is always a passionate advocate for his clients. Joe is also known for going the extra mile. Many prosecutors frankly dread dealing with the numerous pre-trial motions and lengthy evidentiary hearings Joe routinely files and litigates on behalf of his clients. Joe’s peers have recognized his unique blend of hard work and passion by electing him president of Arizona Attorneys for Criminal Justice, Arizona’s leading attorney organization dealing with criminal justice issues, with over 400 members. Joe will be leading this organization during it’s 20th Anniversary year in 2006.

Described as being amongst “Arizona’s top criminal attorneys” by the Arizona Republic (“Prosecutors Sued Over Raid of Office” 11/27/03), Joe’s work has also been recognized by the Arizona State Bar, which has certified him as a specialist in criminal law. Only about 5% of attorneys currently practicing are certified as a specialist in any area of the law. Joe has had the unique privilege of being asked by the Arizona State Bar’s president to serve on two separate state Bar committees simultaneously. On the Criminal Jury Instruction Committee, Joe has helped re-write the instructions on the law given by judges to juries deciding criminal cases in courts throughout Arizona. Joe has also been a longtime member of the State Bar’s Membership Assistance Committee, which helps judges and lawyers with alcohol, substance abuse and mental illness issues. Joe was the committee chairman in 2004. Additionally, Joe was asked by the then-presiding head judge of the Pima County Justice Courts to serve as a part-time judge, which he did in 2003.

In addition to Joe’s extensive experience in DUI defense, Joe is also death penalty-qualified, both in State court where he tried Pima County’s first death penalty case to a jury, and in federal court where he has been appointed as “learned counsel.” Joe in fact has had two back-to-back first degree murder cases in which his clients were acquitted of all murder charges.

Joe gives lectures annually on defending DNA cases at the University of Arizona College of Law, and has taught on the topics of DNA Analysis, Blood Testing in DUI cases, Death Penalty Jury Selection, Death Penalty Trial Strategy, and Victim’s Rights to various attorneys’ groups throughout Arizona and California, and at the National Association of Criminal Defense Lawyer’s Making the Case for Life VIII conference in Oklahoma in 2005.

In addition to trying over 100 cases to juries, Joe has argued cases before the Arizona Court of Appeals, the Arizona Supreme Court and the Ninth Circuit Court of Appeals. Joe persuaded the Arizona Supreme Court to strike down a portion of a criminal statute in State v. Getz, 189 Ariz. 561, 944 P.2d 503 (1997).

Steven D. West is admitted to practice in Arizona & Hawaii. Steve has over twenty years of trial experience, he won his first trial saving the career of an Air Force officer who was wrongfully charged with a career ending crime of moral turpitude. He entered the State of Hawaii Public Defenders Office in 1984. Steve steadily ascended through the ranks of the office aggressively defending clients through Motions and Trial Practice. In 1987 he was promoted to the elite felony trial division at the Public Defender's Office. In that capacity, Steve defended only the most serious of felonies including violent crimes of murder, rape, and kidnaping, along with the most serious drug offenses. In Hawaii he gained immediate notoriety and peer recognition for defending the "Kahala Slasher." Steve is no stranger to high-profile cases, having represented an escaped felon who kidnaped a television cameraman during an extensive manhunt. The case gained national attention when the Oprah Winfrey Show aired the cameraman’s harrowing experience. Steve also tried an emotionally packed Murder by Omission case defending a mentally retarded mother in the death of her six month old baby. After initially losing the trial, Steve successfully argued before the Hawaii Supreme Court that the trial Court erred by refusing to give appropriate instructions on murder by omission. The murder conviction was reversed.

After moving to Tucson and beginning his solo practice, Steve was immediately appointed to the felony defense panels in the Federal District Court and the Pima County Superior Court. In Pima County he was also appointed to the Murder panel. In one of his early high-profile cases, he successfully defended the infamous "Midtown Intruder." He is death-penalty qualified and has been involved with several murder cases in Pima County, including the murder of Walmart executive, Curt Imel, by his family. After the Ring decision by the U.S. Supreme Court, Steve, along with partner Joseph P. St. Louis tried Pima County’s first death-penalty jury trial, from the guilt phase through sentencing. Steve and Joe teamed up again and retried one of the Ring remands. In both cases they successfully obtained verdicts for life.
